The Supreme Court has heard a petition filed by the AP government seeking lifting of the stay imposed by the NGT on the construction of tourism buildings at Rishikonda in Visakhapatnam. The Supreme Court has given the green signal to structures in Rishikonda. The Supreme Court has granted permission to construct structures in the flattened area there.
The Supreme Court said that constructions can be done as usual in an area where there are already structures. The Rushikonda project case has been transferred to the High Court. The Supreme Court ruled that the jurisdiction of the High Court was greater than the jurisdiction of the Tribunal. Despite the High Court order, the NGT ruled that it was not appropriate to disobey.
It clarified that the High Court is a constitutional body and therefore the orders of the High Court have to be enforced. The Supreme Court said that the orders of the High Court should be enforced. The Supreme Court has directed that no trial be held in the NGT till then. The Supreme Court has ruled in favor of NGT.
Based on the letter of MP Raghuram Krishnaraja, the AP government took the pill by suspending the project work and failing to give NGT stay. The Supreme Court made key remarks during the arguments on Tuesday on this petition. He said only letters written by those who could not reach the courts should be considered as petitions.
The government told the court that the project would provide employment to 300 people and was investing Rs 180 crore. The apex court ruled that the NGT’s stay order was based on a letter written by an MP. It is learned that the Supreme Court has adjourned the next hearing in the case to Wednesday. The case was heard on Wednesday. The Supreme Court has given the green signal to the Rishikonda structures.
