The Punjab and Haryana High Court has taken a key decision on the marriages of Muslim girls. A single bench of the High Court has ruled that a 16-year-old Muslim woman can marry a man of her choice. The bench of Justice Jasjit Singh Bedi was hearing a petition filed by a Muslim couple seeking protection of their lives from the family members of a 21-year-old man and a 16-year-old girl. Justice Bedi referred to Sharia law. According to Sharia law, men and women are considered adults by the age of 15. The couple, who got married two weeks ago, had approached the court seeking protection for themselves. The two lovers were married on June 8, 2022 according to Muslim customs.
Their families opposed the marriage and the newlyweds were allegedly threatened by their family members. The newlyweds then approached the High Court. In his judgment, Justice Bedi cited Dinsha Fardoon ji Mulla’s book on Muslim personal law. The judge said that under section 195 of the book, a girl over the age of 16 can marry a man of her choice. Justice Bedi directed the Pathankot police to provide proper security to the newlyweds. The High Court Justice stated in his judgment that their fundamental rights could not be denied because they were married at will.
